Is Time Registration Mandatory?

Yes, time registration is mandatory, but how you do this is up to you. Below are the most important rules that apply:

  1. Dutch Working Hours Act (ATW):
    • The working and rest times of employees must be registered.
    • There are no specific requirements for how this registration should be done.
  2. Invoice requirements (sales tax):
    • The invoice to your client must contain:
      • What services have been provided and the extent (e.g. 1 hour of landscaping work).
      • The date of the services provided.
      • The amount excluding VAT.
      • The unit price.

Adequate time registration is necessary to meet these requirements.

  1. Collective Labor Agreement for Temporary Workers:
    • Employment agencies must inform temporary workers about the method of time registration.
    • The registration must include normal, supplementary and overtime hours and be recorded in writing.
    • The temporary worker must have access to this registration and can request a copy.
    • In the event of a dispute about time registration, the burden of proof lies with the temporary employment agency.

Practical Time Registration

In practice, there are various ways to register hours worked, ranging from digital systems to simple emails from clients. It is important that the registration is clear and accurate, especially for companies with an SNA Quality Mark (NEN 4400 standard).

The Future: Admission to the Provision of Labor Act (Wtta)

The introduction of the Wtta has been postponed, but it is important to ensure good time registration now. The draft standards framework of the Wtta sets the following requirements for time registration:

  • Closing Method: The method must enable control.
  • Minimal Data:
    • Name of the worker.
    • Week, period or month number of the work performed.
    • Number of hours worked (on the invoice).
    • Start and end time per day or shift, including unpaid breaks (not on the invoice).
    • Location of the workplace (not on the invoice).
